Exercising sovereignty is necessary in monitoring and refining cyberspace for maintaining the supremacy and sovereignty of the Islamic system and establishing religious values. General rules that are indicative of prohibition of spying however tell us to protect people's privacy. It is very clear that in the process of monitoring and refining the virtual space, people's privacy may be violated, especially in the area of information and communication.
Since the scope of monitoring and refining cyberspace and also the prohibition of entering people's communication and information domain is not clear in Imami thought, despite emphasis on it, the question of the extent of exercising sovereignty in monitoring and refining cyberspace in relation to the privacy of individuals, is an issue that needs to be explored (problem). The obligation to preserve the Islamic system, the obligation to preserve the supremacy and sovereignty of the Islamic state, and the obligation to establish Islam are among the reasons that give legitimacy to exercising sovereignty while monitoring and refining cyberspace, even if it violates the aforementioned privacy. However, according to the documents, these acts of governance should be done on the basis of knowledge –no matter even if it is partial- within the limits of necessity and without revealing the hidden secrets of people in this space (hypothesis).
This article aims to know the boundaries of the documents that are indicative of monitoring and refining the cyberspace, protecting the information domain of individuals and explaining the jurisprudential indicators in the violation of that privacy (goal). This goal can be achieved in the light of description and analysis of juristic propositions obtained through collecting library-based data (method). The result of this is the analysis and explanation of the extent of sovereignty in monitoring and refining virtual space in relation to people's privacy (findings).
